PRIVACY NOTICE

NATA Compliance Services and its affiliates (each, individually, a “Company” and collectively, “Company”) recognize that their customers, visitors, and others (collectively or individually “Users” or “you”) who access and/or use www.NATACS.aero and/or other Company website(s) (each, a “Company Site” and collectively, the “Company Site(s)”) value their privacy. This Privacy Notice details important information regarding the use and disclosure of User information collected on the Company Site(s). Company provides this Privacy Notice to help Users make an informed decision about whether to use or continue using the Company Site(s). This Privacy Notice is incorporated into and is subject to the Company Site(s) Terms of Use. Your use of the Company Site(s) and any personal information you provide on the Company Site(s) remains subject to the terms of this Privacy Notice and our Terms of Use. As used herein, “affiliate” means any person or entity directly or indirectly controlling or having the power to control, or controlled by or being under common control with another person or entity. For this purpose, “control” means the direct or indirect possession of power to direct or cause the direction of the management or policies of such party, whether through ownership or stock, membership interests or other securities, by contract or otherwise. Ownership of more than fifty percent (50%) of the beneficial interest of an entity shall be conclusive evidence that control exists.

Please note that if, in connection with accessing or using any fingerprint submissions, drug testing, online and on-site employee safety training and any other services accessed by you as a User, you then post any content on the Company Site(s) other than through the secure portion of such Company Site(s), such content becomes published content and is not considered personally identifiable information subject to this Privacy Notice.

The Information Company Collects

Company is a trusted fingerprint facility for the Transportation Security Administration (“TSA”) with respect to a variety of personnel security screening programs, including information from pilots and others regulated by 49 C.F.R. 1544, 49 C.F.R. 1542, 49 C.F.R. 1562, and collects fingerprints and biographical information pertaining to aviation industry workers who must undergo security review and clearance vetting by TSA before they can access sensitive areas of the aviation transportation system, including, without limitation, for TSA’s Twelve-Five Standard Security Program, Private Charter Standard Security Program, Alien Flight Student Program, DCA Access Standard Security Program, Maryland Three Program, among other programs.

Personal and Account Information: You may provide certain personally identifiable information (such as, without limitation, your name, email address, social security number, certificate/license numbers, credit card information, including billing address, citizenship, age, employment/education history information, as well as fingerprint or other biometric identifiers, photographic facial images, system authentication information such as names of relatives, account passwords and personal identification numbers, medical information financial information, or other identifying information) to Company in order to access and use various services through the Company Site(s) such as, without limitation, fingerprint submission, biographical data submission, drug testing, online and on-site employee safety training, and such other services.

Cookies Information: When you visit the Company Site(s), we may send one or more cookies – a small text file containing a string of alphanumeric characters – to your computer that uniquely identifies your browser. Company uses both session cookies and persistent cookies. A persistent cookie remains after you close your browser. Persistent cookies may be used by your browser on subsequent visits to the Company Site(s). Persistent cookies can be removed by following the help file directions in your web browser. A session cookie is temporary and disappears after you close your browser. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of the Company Site(s) may not function properly if the ability to accept cookies is disabled.

Log File Information: When you use the Company Site(s), our servers automatically record certain information that your web browser sends whenever you visit any website. These server logs may include information such as your web request, Internet Protocol (“IP”) address, browser type, browser language, referring/exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time of your request, and one or more cookies that may uniquely identify your browser.

The Way Company Uses Information

If you submit personally identifiable information to us through the Company Site(s), we may need to use your personal information to operate, maintain, and provide to you or your “Sponsor” (defined below) the features and functionality of the Company Site(s) and/or otherwise provide Company products and services or perform our obligations to Sponsors and other third parties. Your access of the Company Site(s) may be for the purpose of providing your information to a governmental agency or self-regulatory organization from whom you are seeking a status, license or certification, or an employer as a condition of employment, status or certification (any such agency, self-regulatory organization or actual or potential employer is referred to as you “Sponsor”). This may include, without limitation, in connection with enrolling and/or providing fingerprint and biographical information for TSA security checks or other third party security programs, employment investigations, criminal history records checks, review of available law enforcement databases and records and other governmental and international agencies. Your use of the Company Site(s) and the personally identifiable information you give to us may be shared with your Sponsor and such other third parties for the above-described purposes. You should contact the relevant agency, self-regulatory organization or employer to learn how they will use and protect your personally identifiable information we forward to them.

Details:

Your account information (for example, full name, email address, birth date and credit card number) is collected for basic Company service. Company will use this information to fulfill its services to you and the Sponsor as follows:

  • Your full name will be used to personalize communications to you and identify you in our system or for communications to the Sponsor.

  • Your email address will be used for identity verification, system messages, personal Company messages (unsubscribe is available in “User Preferences”) and other Company communications.

  • Your credit card information, including your billing address, will be used when you pay for any of the Company services.

We do not use your email address or other personally identifiable information to send commercial or marketing messages to you without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out, such as providing information regarding Company products or services other than the services you then currently receive, which may include products or services provided by affiliates of Company other than those that are then currently providing products and/or services to you. We may use your email address without further consent for non-marketing or administrative purposes (such as notifying you of major Company Site changes, providing the results of services you sought to you or the relevant Sponsor, or for customer service purposes). The Company affiliates that provide the Company Services to you may share your email address and other personally identifiable information with other Company affiliates that are not then currently providing services to you in order for such other Company affiliates to provide their services and to market and sell their services to you.

We will send you service-related announcements on occasions when Company determines that it is necessary to do so. For instance, if our service is temporarily suspended for maintenance, we might send you an email. Generally, you may not opt-out of these communications, which are not promotional in nature. If you do not wish to receive them, you have the option to deactivate your account but without any right of refund for services you have paid for, even if your deactivation prohibits us from completing those services.

We use both your personally identifiable information and certain non-personally-identifiable information (such as anonymous User usage data, cookies, IP addresses, browser type, clickstream data, etc.) to improve the quality and design of the Company Site(s) and to create new features, functionality, and services by storing, tracking, and analyzing User preferences and trends.

We use cookies, clear gifs, and log file information to: (a) remember information so that you will not have to re-enter it during your visit or the next time you visit the Company Site(s); (b) provide custom, personalized content and information; (c) monitor the effectiveness of our marketing campaigns; and (d) monitor aggregate metrics such as total number of visitors, pages viewed, etc.

When Company Discloses Information

We provide personally identifiable information and non-personally-identifiable information to our subsidiaries, affiliated companies, or third parties that provide services to Company and/or in connection providing Company products or services for the purpose of processing such information on our behalf and/or in connection with providing Company products and services, including contacting you related marketing and promotion. We require that these parties agree to process such information in compliance with the relevant terms and conditions of this Privacy Notice, and we use reasonable efforts to limit their use of such information and to use other appropriate confidentiality and security measures.

We do not share your personally identifiable information (such as name or email address) with other, unaffiliated third-party companies for their commercial or marketing use without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out.

We do share non-personally-identifiable information (such as anonymous User usage data, referring / exit pages and URLs, platform types, number of clicks, etc.) with interested third parties to assist them in understanding the usage patterns for certain content, services, advertisements, promotions, and/or functionality on the Company Site(s).

We may release and disclose personally identifiable information and/or non-personally-identifiable information if required to do so by law or to a Sponsor or any other agency, self-regulatory organization or employer from whom you are seeking a particular status, license, certification or employment, and/or in connection with enrolling and/or providing fingerprint and biographical information for Transportation Security Administration security checks or other third party security programs, employment investigations, criminal history records checks, review of available law enforcement databases and records and other governmental and international agencies, or similar services. Your use of the Company Site(s) and the personally identifiable information you give to us may be shared with your Sponsor and such other third parties in connection with providing our products and services and performing our obligations to you and your Sponsor and such other third parties, or as we believe in the good-faith that such action is necessary to comply with state and federal laws (such as U.S. Copyright Law) or respond to a court order, subpoena, or search warrant or comply with any other legal requirement. Sponsors and other governmental agencies, and employers seeking to verify your security status may require access to and disclosure of your user identifiable information and other information in connection with their security reviews, audits and inspections of Company Site(s) and Company records, systems, products and services. One Sponsor, governmental agency or employer which has received your information in connection therewith may allow another Sponsor’s, governmental agency’s or employer’s use of your information obtained in connection with prior clearance of your security status to conduct their own security review.

Company also reserves the right to disclose personally identifiable information and/or non-personally identifiable information that Company believes, in good faith, is appropriate or necessary to enforce our Terms of Use, take precautions against liability, to investigate and defend itself against any third-party claims or allegations, to assist government enforcement agencies, to protect the security or integrity of our Company Site(s), and to protect the rights, property, or personal safety of Company, our Users and/or others. Company may also use user identifiable information to investigate and help prevent potentially unlawful activity or activity that threatens the network or otherwise violates Terms of Use. We may also use and disclose to third parties user identifiable and/or other information about you that was obtained from other sources on a non-confidential basis.

Your Choices

User Opt-Out: You may choose not to receive direct marketing communications from Company in connection with the Company Site(s) by providing written notification to Company making such request. If Company receives such a request from you, Company thereafter will not contact you directly with marketing messages about Company’s products or services. You may choose not to receive such messages by notifying Company via e-mail or regular U.S. mail. Please note, however, that any such opt out only applies to Company and will not apply to any other third parties to which Company has supplied your user identifiable information. Additionally, you acknowledge and agree that such opt-out notification processing may not be immediate, and you agree that should you receive additional communications your rights and remedies are limited to contacting us to reiterate your request to opt-out. You may not opt out of non-marketing communications.

Decline to Submit Personally Identifiable Information: You may, of course, decline to submit personally identifiable information through the Company Site(s), in which case Company may not be able to provide certain services to you, and this may make you ineligible for the status, license, certification or employment you are seeking. You may update or correct your personal profile information and email preferences at any time by visiting your account profile page. Except to the extent that our obligations to any agency, self-regulatory organization, employer or other third party requires otherwise, or your relationship with an agency, self-regulatory organization or employer requires us to retain information you previously gave us, you can also request that your personal information be updated or deleted at any time by emailing info@natacs.aero. Updates, inaccuracies, and requests for deletion will be responded to within 72 hours. Please note that certain information uploaded by Users to the Company Site(s) may not be able to be removed and remain subject to our Terms of Use.

To protect your privacy and security, we take commercially reasonable steps (such as requesting a unique password) to verify your identity before granting you profile access or making corrections. You are responsible for maintaining the secrecy of your unique password and account information at all times.

Third-party Advertisers, Links to Other Sites

Company may allow other companies, such as third-party ad servers or ad networks, to serve and display advertisements within the Company Site(s). These third-party ad servers or ad networks use technology to send, directly to your browser, the advertisements and links that appear on the Company Site(s). They automatically receive your IP address when this happens. They may also use other technologies (such as cookies and JavaScript) to measure the effectiveness of their advertisements and to personalize the advertising content you see. Company does not provide any personally identifiable information to these third-party ad servers or ad networks without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out. However, please note that if an advertiser asks Company to show an advertisement to a certain audience (for example, men ages 18-34) or audience segment (for example, men ages 18-24 who have viewed certain channels of content) and you respond to that advertisement, the advertiser or ad-server may conclude that you fit the description of the audience they are trying to reach. The advertiser may also use information regarding your use of the Company Site(s), such as the number of times you viewed an ad (but not any personally identifiable information), to determine which ads to deliver to you.

You should consult the respective privacy policies of these third-party ad servers or ad networks (see links below) for more information on their practices and for instructions on how to opt-out of certain practices. Company’s privacy policy does not apply to, and we cannot control the activities of, such other advertisers or web sites.

Currently, Company has relationships with various third-party ad servers or ad networks and may establish new relationships or discontinue relationships with such third parties from time to time. The Company uses various tracking services to track access and usage of the Company Site(s).

Agents

We use a credit card processing company to bill you for goods and services. To Company’s knowledge, such credit card processing company does not retain, share, store or use personally identifiable information for any other purposes than in connection with providing their credit card processing services.

Our Commitment to Data Security

Company uses commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information. We cannot, however, ensure or warrant the security of any information you transmit to Company, and you do so at your own risk. Once we receive your transmission of information, Company makes commercially reasonable efforts to ensure the security of our systems. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach despite our use of commercially reasonable physical, technical, or managerial safeguards. You acknowledge and agree that perfect security is not possible and your user identifiable information could still be accessed and used by others without authorization. Your access and use of the Company Site(s) constitutes your agreement that Company and its affiliates are not and shall not be responsible for any such unauthorized access and use of your user identifiable information.

If Company learns of a security systems breach, we shall attempt to notify you electronically so that you can take appropriate protective steps unless we are reasonably able to determine that such breach did not likely result in the disclosure of any of your non-public personally identifying information or such notification. Company may also post a notice on the Company Site(s) if a security breach occurs. Depending on where you live, you may have a legal right to receive notice of a security breach in writing. To receive a free written notice of a security breach that affects your personally identifiable information (or to withdraw your consent from receiving electronic notice) you should notify us by emailing info@NATACS.com.

The security of your personal information is important to us. When you enter sensitive information (such as credit card number and/or social security number) on our Company Site(s), we encrypt the transfer of that information using secure socket layer technology (SSL).

Our Commitment To Children’s Privacy

Protecting the privacy of young children is especially important to Company. For that reason, Company does not knowingly collect or maintain personally identifiable information or nonpersonally- identifiable information on the Company Site(s) from persons under 13 years of age, and no part of the Company Site(s) is directed to persons under 13. If you are under 13 years of age, then please do not use or access the Company Site(s) at any time or in any manner. If Company learns that personally identifiable information of persons less than 13 years of age has been collected on the Company Site(s) without verified parental consent, then Company will take the appropriate steps to delete this information.

Safe Harbor

Company intends to comply with the EU Safe Harbor framework as set forth by the Department of Commerce regarding the collection, use, and retention of data from the European Union, but you should verify that any Sponsor or other agency, self-regulatory organization or employer with whom you interact through or related to a Company Site will also so comply, if the EU Data Privacy Protection Directive would apply to you.

Special Note to International Users

The Company Site(s) is/are hosted in the United States and are intended for and directed to Users in the United States, United Kingdom, the European Union and Canada, and possibly other countries. If you are a User accessing the Company Site(s) from Asia, or any other region with laws or regulations governing personal data collection, use, and disclosure that may differ from United States laws, please be advised that through your continued use of the Company Site(s), which are governed by U.S. law, this Privacy Notice, and our Terms of Use, you are transferring your personal information to the United States and you consent to that transfer and to being governed by applicable United States laws.

Privacy Act Notification

Company shall comply with the Privacy Act of 1974 (the “Act”) and all agency rules and regulations issued under the Act. In the event of violations of the Act, a civil action may be brought against the agency involved when the violation concerns the design, development or operation of a system of records on individuals to accomplish an agency function, and criminal penalties may be imposed upon the officers or employees of the agency when the violation concerns the design, development or operation of a system of records on individuals to accomplish an agency function. For the purpose of the Act, when the agreement is for the operation of a system of records on individuals to accomplish an agency function, Company shall be considered to be an employee of the agency. Operation of a system of records, as used in this clause, means performance of any of the activities associated with maintaining a system of records, including the collection, use and dissemination of records.

Business Transitions

In the event Company goes through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of its assets, your personally identifiable information will likely be among the assets transferred. You hereby irrevocably consent to the assignment, sale or other transfer of rights, title or interests with respect to your personally identifiable information in Company’s possession or control in connection with such a business transition. Company will provide notification via email and/or a prominent notice posted for a period of 30 days on the relevant Company Site(s), in the event of any such change in ownership or control of your personal information.

Changes and Updates to this Privacy Notice

We reserve the right to modify this Privacy Notice at any time, so please review it frequently. If we make material changes to this Privacy Notice, we will notify you here, by e-mail, and/or by means of a notice on the home page of the relevant Company Site(s), so that you may be aware of what information we collect, how we use it and under what circumstances, if any, we disclose it. Access and/or use of the Company Site(s) following any modifications to the Privacy Notice constitutes your agreement to follow and be bound by this Privacy Notice as changed.
